Abstract

The new action for judicial review of the regularity and legality of dismissals is applied to redundancies, formalized by written proceeding, caused by employee’s conduct and on the basis that the job has become defunct or due to the employee’s unsuitability for the job. Verbal redundancies are excluded from this new action, therefore, remaining in the previous procedural regime. This paper aims to briefly analyse the procedural stages and the rules introduced in the new labour code.
