Abstract<\/strong><\/p>\n\n\n\n

After a general reflection on the death penalty we are approached the Theories of the Purposes of Penalties (Teorias das Finalidades das Penas), highlighting the adopted by the Portuguese Law. It is established the relationship between the application of penalties, which is an obligation of the State in the exercise of judicial power and its mission to protect fundamental rights. The conclusion of the defense of the prohibition of the death penalty, as it is enshrined in the Portuguese legal system as a reflection of the values underlying European civilization.<\/p>\n\n\n\n
