Abstract<\/strong><\/p>\n\n\n\n

The right to information by the administered has a decisive relevance for the realization of the \u201cPublic Administration\u201d that fulfills the constitutional values and principles. That right has several dimensions, not only the right to access to information, clarifications, explanations, public documents and administrative records, but also as a mechanism of defense before the Public Administration. The main purpose of this right is, in our point of view, to strengthen the guarantee\u2019s position of the administered, in the phase of previous hearing, by the participation in decisions that concern him directly or that concerns the \u201cdiffuse rights\u201d. The other important dimension of the right to information is that contributes to the greater democraticity and legitimacy of the Public Administration because it implements transparency, impartiality and objectivity in its procedure. For these reasons, the Public Administration will always aim, whenever possible, for the best option for the public interest and, therefore, the \u201cWell-Being of the Collectivity\u201d. Any deviation from the public interest will be of public knowledge, since the scrutiny that the information enhances serves as a control of the administrative activity.<\/p>\n\n\n\n
