Abstract<\/strong><\/p>\n\n\n\n

The work in question intended to be both a reflection and analysis of incompatibilities and impediments for implementation of execution solicitors, established by Decree Law 88\/2003 of April 26th. The specialty established by that law, has determined for the execution solicitors, the assumption of new responsibilities and different from existing as well as an ethical approach and behavior accordingly, which is also innovative. The distant position of the parties involved in executive procedure, impartiality, transparency and the exemption, are prerogative of the execution solicitors, which is why it is imperative that it shows and defines clearly the legal position of this new judicial , especially in executive action. Incompatibilities and impediments of those professionals are indelible mark of new and distinct behavioral reality and positioning.<\/p>\n\n\n\n
